JUVENILE DEFENSE

Juvenile Defense in Tucson

When a young person faces criminal charges, the stakes are uniquely high. The juvenile justice system offers opportunities for rehabilitation, but it requires an attorney who understands how to navigate it effectively.

Understanding the Charge

Arizona's juvenile justice system is designed to rehabilitate rather than punish, but it still carries serious consequences. Juveniles can be adjudicated delinquent (the juvenile equivalent of a conviction) for the same offenses that adults face, including assault, drug possession, theft, DUI, and even violent felonies. In some cases, juveniles can be transferred to adult court, where they face the same penalties as adults.

Juvenile proceedings are handled in the Juvenile Division of Pima County Superior Court and follow different procedures than adult court. There is no right to a jury trial in juvenile proceedings; instead, a judge makes all findings. The focus is on the best interests of the child, but the court also considers public safety. The outcomes can range from diversion programs and probation to commitment to the Arizona Department of Juvenile Corrections.

Potential Penalties

DiversionInformal supervision, community service, counseling, or restitution; no formal adjudication
ProbationCourt-supervised probation with conditions such as school attendance, curfew, counseling, community service, and regular check-ins
Commitment to ADJCFor serious offenses, the juvenile may be committed to the Arizona Department of Juvenile Corrections for a period determined by the court
Transfer to Adult CourtFor serious felonies, the prosecution may seek to transfer the juvenile to adult court where adult penalties apply

How Doug Defends

  • Advocating for diversion programs that keep the juvenile out of the formal court system and provide rehabilitative services
  • Challenging the sufficiency of the evidence and ensuring that the juvenile's constitutional rights are protected throughout the process
  • Opposing transfer motions that seek to move the case to adult court, presenting evidence of the juvenile's amenability to treatment
  • Working with families, schools, and community resources to demonstrate a plan for rehabilitation and accountability

Doug Taylor understands that juvenile cases require a different approach than adult criminal defense. His goal is to protect the young person's future by pursuing outcomes that emphasize rehabilitation, education, and accountability. His experience as a judge gives him credibility with juvenile court judges and an understanding of what the court needs to see when considering alternatives to formal adjudication.
